Eligibility

Employees of all job classifications, including student employees, are eligible for Family Medical Leave (FML) if they have worked at 51³Ô¹ÏºÚÁÏ for a total of 12 months and worked at least 1,250 hours (roughly 24 hours per week) during the 12 months preceding the requested leave date.

Employment includes appointments at any NSHE campus, regardless of any breaks in service. National Guard and reserve military duty also count toward the 12-month eligibility requirement.

Reasons for Taking Leave

According to the federal government, employees may take FMLA leave for the following reasons:

  • The birth of a child or placement of a child for adoption or in foster care
  • Bonding with a child within one year of child’s birth or adoption
  • A serious, qualifying health condition that makes the employee unable to perform one or more essential functions of their job
  • To care for a spouse, child, registered domestic partner, or parent with a qualifying health condition
  • Qualifying exigencies related to foreign deployment of a military member who is the employee’s spouse, child, or parent
  • Service Member Care Leave (SMCL) for a covered service member with a serious injury or illness, if the employee is the spouse, registered domestic partner, son, daughter, parent, or next of kin of the service member

An employee does not need to use leave in one block. When it is medically necessary or otherwise permitted, employees may take leave intermittently or on a reduced schedule.

Requesting FMLA

Employees must provide 30 days’ advance notice for foreseeable leave. When 30 days’ notice is not possible, the employee must give notice to the employer by the next business day after they learn of the need for leave, unless impracticable to do so.

Procedures

Inform Inform your supervisor and the 51³Ô¹ÏºÚÁÏ benefits team of the need to take family medical leave.
File paperwork

Obtain and complete the necessary leave of absence forms (located above) based on the leave type you request:

  • Complete the Department of Labor medical leave of absence request form and submit to the Absence Coordinator for review.
Review

Review the following documentation:

  • (informs employees of their eligibility or lack of eligibility under FMLA)
Consult healthcare provider You or your family member must complete the Certification of Healthcare Provider (CHCP) form and submit it directly to 51³Ô¹ÏºÚÁÏ benefits prior to the 15 calendar day deadline indicated on your Notice of Eligibility.

During Your Leave

Once your leave is approved, review the designation notice provided to you by the benefits team, and begin taking your leave (or continue leave if you are already out of the office). Please follow these guidelines:

  • Comply with all normal call-in procedures and notify your department if the absence is related to your FMLA leave
  • Keep in contact with your department and the benefits team should the dates of your leave change
  • Do not discuss any medical information with your department
  • If you are on medical leave, do not perform any work, including responding to email or work-related phone calls
  • Report any time taken under FMLA to your department/supervisor

The benefits team will instruct you how to manage time off in Workday.

Returning to Work

Employees should contact the benefits office and their supervisor to arrange for a return to work. At least two (2) days advance notice may be required to return to active status.

Employees must submit the directly to benefits in order to return to work. Depending on your leave type, there are different return to work procedures. These are outlined in the employee’s role in requesting FMLA leave packet and webpage.

Medical Benefits

Medical benefits continue while employees are on approved FMLA leave. Employees are responsible for their portion of their health insurance premiums, which will be deducted during paid status. Contact benefits at 702-895-3504 to make arrangements to cover premiums during unpaid status.
